These Terms and Conditions act as a legal contract between you (the donor) and Oxfam Australia (ABN 18 055 208 636). Use of this If Then Give app is subject to the following Terms and Conditions.
When creating an If Then Give app account, you agree that you:
a) have read, understand and agree to these Terms & Conditions, the Participant Information and the Refund Policy;
b) provide your consent to take part in the research described in the Participant Information;
c) have read, understand and accept the Lancaster University Research Privacy Notice in respect of any information that you provide through the If Then Give app or otherwise in connection with the research described in the Participant Information; and
d) have read, understand, and accept the Oxfam Australia Privacy Policyand provide your consent for Oxfam Australia to collect your information (as set out in the Data and Privacy page of this website) in order to process donations, issue receipts and provide further opportunities for you to engage with and support Oxfam Australia.
Oxfam Australia reserves the right to change these Terms and Conditions at any time by informing its users via email. Your continued use of the If Then Give app after changes are posted constitutes your acceptance of this agreement as modified.
You agree to use the If Then Give app only for lawful purposes, and in a manner which does not infringe the rights, or restrict, or inhibit the use and enjoyment of the site by any third party.
Oxfam Australia and its research partners (Lancaster University, Edinburgh University) do not warrant that the functions contained in the material in this site/ app will be uninterrupted or error free, that defects will be corrected, or that this site/app and the server that makes it available are free of viruses, bugs or represents the full functionality, accuracy and reliability of the materials.
Material on this site comes from a variety of sources and authors including: staff members, volunteers, overseas partner organisations, Oxfam Australia group members and supporters. Oxfam Australia does not necessarily endorse the views expressed by contributors to this site.
Any information in this app, names, images, pictures, logos regarding or relating to Oxfam Australia are provided "as is", without any representation or endorsement made and without warranty of any kind whether expressed or implied. To the fullest extent permitted under applicable law, the researchers and Oxfam Australia disclaim any implied or statutory warranty, including any implied warranty of title, non-infringement, merchantability or fitness for a particular purpose in respect of the If Then Give app.
For the avoidance of doubt, the If Then Give App is a pre-release in a research context, and is expected to contain defects which may be material, and are not expected to operate at the level of performance or compatibility of a final, generally available product offering. Thus, this software may not operate accurately and may be substantially modified prior to public availability or withdrawn at any time, in which case any remaining funds are being donated unrestricted to Oxfam Australia. Accordingly, access to and use of the If Then Give app is entirely at customer's own risk.
In no event shall the researchers or Oxfam Australia, be liable for any damage whatsoever arising out of the use of or inability to use the If Then Give app, even if the researchers or Oxfam Australia have been advised of the possibility of such damages. You are advised to safeguard important data, to use caution and not to rely in any way on the correct functioning or performance of any pre-release product.
Oxfam Australia and the research partners reserve the right to terminate this research (including the use of the app) without notice or giving reasons, in which case any remaining funds are being donated unrestricted to Oxfam Australia.
Oxfam Australia and the research partners will pursue with the best intentions to provide the platform and app for the duration of the research but reserves the right, without notice to you, to suspend or terminate your account, or suspend or terminate the ability to use our services, if we suspect that a user acts fraudulently, unlawfully, or otherwise in violation of these terms and conditions, or if the case of significant technical or security relevant issues.
If there is any conflict between these Terms and Conditions and rules and/or specific terms of use appearing on this website/app relating to specific material then the latter shall prevail.
These terms and conditions shall be governed and construed in accordance with the laws of Victoria. Any disputes shall be subject to the exclusive jurisdiction of the Courts of Victoria.
If these Terms and Conditions are not accepted in full, the use of this app must be terminated immediately.
